Cet article apporte une réflexion sur l’influence de la médicalisation de l’accouchement sur le lien mère-bébé, dans une époque où les violences obstétricales sont dénoncées et où les femmes aspirent à se réapproprier leur accouchement. L’analyse du discours maternel lors d’entretiens semi-directifs ainsi que les observations cliniques des relations selon le type d’accouchement ont permis d’observer que la majorité des vécus négatifs des mères concernant leur accouchement apparaissent lorsque celui-ci est plus médicalisé (péridurale, césarienne...). Les observations mère-bébé sont généralement congruentes (...) avec le vécu maternel. Les résultats soulignent l’importance de prendre davantage en considération les mères avant et après leur accouchement pour favoriser l’élaboration, mais aussi le repérage de parents souffrant dans leur parentalité. This paper discusses the establishment of a governance framework to secure the development and deployment of “good AI”, and describes the quest for a morally objective compass to steer it. Asserting that human rights can provide such compass, this paper first examines what a human rights-based approach to AI governance entails, and sets out the promise it propagates. Subsequently, it examines the pitfalls associated with human rights, particularly focusing on the criticism that these rights may be too Western, too individualistic, (...) too narrow in scope and too abstract to form the basis of sound AI governance. After rebutting these reproaches, a plea is made to move beyond the calls for a human rights-based approach, and start taking the necessary steps to attain its realisation. It is argued that, without elucidating the applicability and enforceability of human rights in the context of AI; adopting legal rules that concretise those rights where appropriate; enhancing existing enforcement mechanisms and securing an underlying societal infrastructure that enables human rights in the first place, any human rights-based governance framework for AI risks falling short of its purpose. Collective action processes in complex, multiple-use common-pool resources (CPRs) have only recently become a focus of study. When CPRs evolve into more complex systems, resource use by separate user groups becomes increasingly interdependent. This implies, amongst others, that the institutional framework governing resource use has to be re-negotiated to avoid adverse impacts associated with the increased access of any new stakeholders, such as overexploitation, alienation of traditional users, and inter-user conflicts. The establishment of “platforms for resource use negotiation” is a (...) way of dealing with complex natural resource management problems. Platforms arise when stakeholders perceive the same resource management problem, realize their interdependence in solving it, and come together to agree on action strategies for solving the problem (Röling, 1994). This article sets the scene for a discussion in this Special Issue about the potential of nested platforms for resource use negotiation in facilitating collective action in the management of complex, multiple-use CPRs. The article has five objectives. First, we define “collective action” in the context of this paper. Second, we discuss the importance of collective action in multiple-use CPRs. Third, we introduce the concept of platforms to coordinate collective action by multiple users. Fourth, we address some issues that emerge from evidence in the field regarding the role and potential of nested platforms for managing complex CPRs. Finally, we raise five discussion statements. These will form the basis for the collection of articles in this special issue. (shrink)

We analyze the transition of central banks from lenders to market makers of last resort. The adoption of unconventional monetary policies characterizes this transition. In their new role as market makers, central banks engage in the latter by extending and reinforcing interventions in other markets than the traditional bank reserves market. We then explain that the difference between the two roles is one of degree rather than kind. In both cases, the prevention of liquidity shortages is a primary concern. As (...) conventional policies become inadequate, central banks resort to unconventional policies to escape a general liquidity shortage at the zero lower bound. However, these unconventional policies do not solve the structural problems in financial and real markets. Both conventional and unconventional monetary policies cause price distortions, in particular on asset markets. The policies of the market maker of last resort prevent necessary readjustments of cyclical divergences between real and financial markets. (shrink)

Fair resource allocation in humanitarian medicine is gaining in importance and complexity, but remains insufficiently explored. It raises specific issues regarding non-ideal fairness, global solidarity, legitimacy in non-governmental institutions and conflicts of interest. All would benefit from further exploration. We propose that some headway could be made by adapting existing frameworks of procedural fairness for use in humanitarian organizations. Despite the difficulties in applying it to humanitarian medicine, it is possible to partly adapt Daniels and Sabin's ‘Accountability for reasonableness’ to (...) this context. This would require: (1) inclusion of internally explicit decisions and rationales; (2) publicity to donors, local staff, community leaders and governments, as well as frank answers to any beneficiary—or potential beneficiary—who asked for clarification of decisions and their rationale; (3) a consistent reasoning strategy to weigh conflicting views of equity in specific situations; (4) advocacy within the organization as a mechanism for revision and appeals; and (5) internal regulation according to publicly accessible mechanisms. Organizations could generate a common corpus of allocation decisions from which to draw in future similar cases. Importantly, the complexity of these challenges should encourage, rather than hinder, broader discussion on ethical aspects of resource allocation in humanitarian medicine. These outbreaks can be seen as a paradigm for ethical issues posed by epidemic emergencies, through the convergence of such themes as: isolation and quarantine, privacy and confidentiality and the interpretation of ethical norms across different ethnocultural settings. With an emphasis on the boundaries between public health investigations and research, this article reviews specific challenges, past practices and current normative documents relevant to the application of ethical standards in the course of outbreaks of filovirus hemorrhagic fevers. Aside from commonly identified issues of informed consent and institutional review processes, we argue for more clarity over the specification of which communities are expected to share benefits, and we advocate for the use of collective definitions of duty to care and standard of care. We propose new elaborations around existing normative instruments, and we suggest some pathways toward more comprehensive approaches to the ethics of research in outbreak situations. We would like to respond to the comment we received from our colleagues on our case report about organ donation after euthanasia starting at home. We reply to their statements on medical and legal aspects, and provide more information on our view of informed consent.

BackgroundThe COVID-19 pandemic has created ethical challenges for intensive care unit (ICU) professionals, potentially causing moral distress. This study explored the levels and causes of moral distress and the ethical climate in Dutch ICUs during COVID-19.MethodsAn extended version of the Measurement of Moral Distress for Healthcare Professionals (MMD-HP) and Ethical Decision Making Climate Questionnaire (EDMCQ) were online distributed among all 84 ICUs. Moral distress scores in nurses and intensivists were compared with the historical control group one year before COVID-19. ResultsThree (...) hundred forty-five nurses (70.7%), 40 intensivists (8.2%), and 103 supporting staff (21.1%) completed the survey. Moral distress levels were higher for nurses than supporting staff. Moral distress levels in intensivists did not differ significantly from those of nurses and supporting staff. “Inadequate emotional support for patients and their families” was the highest-ranked cause of moral distress for all groups of professionals. Of all factors, all professions rated the ethical climate most positively regarding the culture of mutual respect, ethical awareness and support. “Culture of not avoiding end-of-life-decisions” and “Self-reflective and empowering leadership” received the lowest mean scores. Moral distress scores during COVID-19 were significantly lower for ICU nurses (p < 0.001) and intensivists (p < 0.05) compared to one year prior.ConclusionLevels and causes of moral distress vary between ICU professionals and differ from the historical control group. Targeted interventions that address moral distress during a crisis are desirable to improve the mental health and retention of ICU professionals and the quality of patient care. (shrink)

Manzo (2023/2020, this volume) objects to Nathalie Bulle's article with Denis Phan “Can Analytical Sociology Do Without Methodological Individualism?” (Philosophy of the Social Sciences, 2018) that the rationality associated with the understanding interpretation of MI cannot be taken to be trans-situational. This reply argues that either (1) this is a misunderstanding resulting from a confusion between the general rational capacity of human beings, to which Bulle and Phan refer, and the specific behavioral patterns associated with given situations and models (...) or (2) this objection supports a structural reductionism in which the structural level tends to “reduce” the individual level, so that the behavioral patterns are directly implied by the structures. To see "democracy as a tragic regime", as Cornelius Castoriadis did, is to recognize the ever-present risk of democracy’s cancellation, but it also means to emphasize the anti-democratic nature of such cancellation, thus its incompatibility with democracy. In the context of this understanding of democracy, the article takes the political to consist of those relations among people and among institutions within the polis, which aim at deciding about the polis’ fate. It takes the social to be those relations among people (...) and among institutions within the polis, to whom such decisions about the polis’ fate apply and whom they create. If democracy is understood as tension between the two, then the relation between those who decide and those who are subject of the decision is never entirely pacified – hence, always contested and in need of specification. Using the examples of the state of exception and totalitarianism (temporary and permanent self-cancellation), the article argues that these situations are outside a linear continuation with the democratic phenomenon and are due to a displacement, which is akin to the hubristic displacement. Research on the influence of industry on chemical regulation has mostly been conducted within the framework of the production of ignorance. This special issue extends this research by looking at how industry asserts its interests––not just in the scientific sphere but also at other stages of policy-making and regulatory process––with a specific focus on the types of tools or instruments industry has used. Bringing together sociologists and historians specialized in Science and Technology Studies, the articles of the special issue study (...) the arenas in which instruments and practical guidelines for public policy are negotiated or used. The aim is to observe the devices in the making or in action, from the selection of actors to the production of thresholds, criteria, and other technical regulations. The introduction highlights how industry influence on expertise and regulation is undoubtedly far more pervasive and multifarious than has been conceptualized to date by social scientists. Putting this issue back at the heart of both the STS and social sciences research agendas is increasingly urgent and could lead to new inquiries able to highlight these logics even more widely, using fresh empirical examples. There is growing evidence that words that are acquired early in life are processed faster and more accurately than words acquired later, even by adults. As neuropsychological and neuroimaging studies have implicated different brain networks in the processing of action verbs and concrete nouns, the present study was aimed at contrasting reaction times to early and later-acquired action verbs and concrete nouns, in order to determine whether effects of word learning age express differently for the two types of words. Our (...) results show that while word frequency affected both types of words in the same way, distinct learning age effects were observed for action verbs and concrete nouns. A further experiment specified that this difference was observed for verbs describing actions belonging to the human motor repertoire, but not for verbs denoting actions past this repertoire (e.g., to neigh). We interpret these data within a recently emerging framework according to which language processing is associated with sensory motor programs. (shrink)

In this chapter Nathalie Sigot argues that Bentham’s interest in international trade lies in the consideration of the redistributive effects of trade and its consequences on happiness for one’s society. Sigot demonstrates that Bentham’s view on international trade changed between 1786 and 1821, when the principle of the limitation of industry by capital disappeared from his writings. Les recherches menées dans le champ de la psychologie morale par Larry P. Nucci et Elliot Turiel conduisent à identifier le domaine moral avec le domaine des jugements prescriptifs concernant la manière dont nous devons nous comporter à l’égard des autres personnes. Ces travaux empiriques pourraient apporter du crédit aux propositions normatives du philosophe Ruwen Ogien qui défend une conception minimaliste de l’éthique. L’éthique minimale exclut en particulier le rapport à soi du domaine moral. À mon avis cependant, ces travaux (...) de psychologie morale ne permettent pas du tout d’affirmer que nous sommes, empiriquement parlant, des minimalistes moraux. Les résultats des recherches de Nucci et Turiel montrent que les personnes considèrent intuitivement que le domaine personnel – le domaine des actions qui affectent prioritairement l’agent lui-même – doit échapper au contrôle ou à l’interférence des autres personnes. Mais affirmer que c’est l’agent lui-même qui possède l’autorité légitime de décider dans le domaine personnel ne signifie pas que tout ce qu’il y fait soit moralement indifférent. (shrink)

It is important to understand the drivers of green consumption, because of growing concern for the health of the planet. In this paper, the assumption that a virtue-green product relationship exists is tested. The objective is to understand how product morality can influence the valuation of green products. Relying on virtue theory and positive spillover as conceptual bases, the research implicitly and explicitly tests and confirms green product virtue. The results demonstrate that perceived green product virtue leads to positive emotions, (...) which explain heightened purchase intentions. In line with the conceptualization, I show that the effect is moderated by the importance consumers place on their own morality. Importantly, explicitly framing green products as virtuous activates positive spillover by consumers; when green products are branded with a virtue cue, they encourage consumers to be more virtuous. Beyond being perceived as better people, when consumers interact with green products they effectively engage in more moral acts, such as making donations. The results confirm the perception of green products as moral agents and provide marketers with insights into the marketing value of virtue cues in green product consumption. (shrink)

L’authenticité est peu étudiée par les économistes, quand est abordée, c’est à travers les liens qu’elle entretient avec la qualité. Nous montrons que tant qu’il était possible d’établir la qualité artistique de l’œuvre à partir d’un étalon prédéterminé, la question de l’authenticité se réduisait à celle d’attribution : comment les faux, les copies perturbent-ils le déroulement normal des échanges. Nous montrons l’apparition de la convention d’originalité au milieu du xixe siècle a conduit a opacifier la notion d’authenticité a été opacifiée. (...) Son registre n’est plus celui de la simple attribution mais également celui de la sincérité d’une démarche. Par ailleurs elle n’intervient plus seulement en aval mais participe à la définition même de la qualité. Mon objectif dans cette contribution est d’explorer la pratique phénoménologique en jeu au sein même des descriptions de Michel Foucault. Un tel travail dépasse la portée d’un examen unique et ponctuel et supposerait de mobiliser les champs expérientiels multiples qu’a observés et traités Foucault de l’intérieur : la prison, la clinique, la sexualité. Il sera ici circonscrit à ce que je crois être le noyau de la pratique en jeu. Ce que Foucault nomme de son côté « le souci de (...) soi », « la pratique de soi » ou encore « la technique de soi », et c’est ce qui permet de mettre au jour la conception foucaldienne du sujet comme soi. Pour ce faire, je vais parcourir le Cours de 1981-1982 en suivant le fil conducteur des occurrences du thème de l’attention. Pourquoi cela? Je suis guidée, dans ce parcours, par l’hypothèse selon laquelle l’attention (plus que la réflexion qui est retour sur soi et clôture, donc en définitive objectivante) est, pour la phénoménologie, le nom concret, expérientiel, pratique de l’ épochè, c’est-à-dire de la relation à soi du sujet comme présence à soi. Foucault ne parlant jamais d’ épochè ou de réduction (ni d’ailleurs de réflexion), mais plutôt d’attention, en lien avec le souci de soi, la pratique de soi, ou encore l’exercice, il semble que les concepts méthodiques husserliens, ou toute philosophie réflexive résiduelle, ne peuvent que faire écran à l’intuition immédiate du sens de l’expérience et doivent être évités au profit de termes plus sobres et d’emblée intelligibles comme l’attention, le souci et le soin. BackgroundA patient who fulfils the due diligence requirements for euthanasia, and is medically suitable, is able to donate his organs after euthanasia in Belgium, the Netherlands and Canada. Since 2012, more than 70 patients have undergone this combined procedure in the Netherlands. Even though all patients who undergo euthanasia are suffering hopelessly and unbearably, some of these patients are nevertheless willing to help others in need of an organ. Organ donation after euthanasia is a so-called donation after circulatory death (DCD), (...) Maastricht category III procedure, which takes place following cardiac arrest, comparable to donation after withdrawal of life sustaining therapy in critically ill patients. To minimize the period of organ ischemia, the patient is transported to the operating room immediately after the legally mandated no-touch period of 5 min following circulatory arrest. This means that the organ donation procedure following euthanasia must take place in the hospital, which appears to be insurmountable to many patients who are willing to donate, since they already spent a lot of time in the hospital. Case presentationThis article describes the procedure of organ donation after euthanasia starting at home (ODAEH) following anesthesia in a former health care professional suffering from multiple system atrophy. This case is unique for at least two reasons. He spent his last conscious hours surrounded by his family at home, after which he underwent general anaesthesia and was intubated, before being transported to the hospital for euthanasia and organ donation. In addition, the patient explicitly requested the euthanasia to be performed in the preparation room, next to the operating room, in order to limit the period of organ ischemia due to transport time from the intensive care unit to the operating room. The medical, legal and ethical considerations related to this illustrative case are subsequently discussed.ConclusionsOrgan donation after euthanasia is a pure act of altruism. This combined procedure can also be performed after the patient has been anesthetized at home and during transportation to the hospital. (shrink)

The fundamental difference between Castoriadis' and Papaioannou's accounts of the link between tragedy and the political is that Castoriadis insists on a political form whilst Papaioannou insists on a social actor. The starting point for this essay, then, are two thinkers: one whose main interest was a political and philosophical reflection on the social-historical and one whose main interest was a philosophical reflection on the arts. Surprisingly, however, the end situation is one where Castoriadis gives us a political explanation of (...) the link between tragedy and the political whilst Papaioannou gives us a social explanation of the same phenomenon. How can this difference be accounted for? First, distinguishing their respective conceptualisations of the political allows us to see that where one thinker privileges restlessness and revolution, the other privileges law and regime. Second, looking at their depictions of the essential aspects of tragedy places them on opposing sides of the couple hubris- dike, in a way that leads to two radically different conceptualisations of the relation in question. This paper is intended to draw the main theoretical lines of the notion of value, in order to avoid some flaws in the quantitative surveys on values as well as in some qualitative studies of value judgements. Through a number of redefinitions based on a pragmatic approach, inspired not only by Dewey’s concept of ‘valuation’ but also by the new French pragmatic sociology and by the pragmatist trend in linguistics, it tries to specify the conditions under which sociology can address (...) the notion of ‘value’ while avoiding their reduction to scholarly supports for morals or normative guides for action and evaluation. Meanwhile, it tries to construct a unified concept of value that would work for all the concerned disciplines: not only sociology but also economics, psychology, anthropology, and even philosophy. The invisible object, in the eighteenth century, is not an evidence. It is the result of textual and semantic learning. Which concrete strategies are used to construct and depict objects out of sight? How do we make them a cognitive reality acceptable to a scientific community? This paper first highlights the conditions for the emergence of a field of microscopic knowledge and its epistemological consequences. Then we consider the microscopic gaze in terms of learning, situated between the act of observation (...) as such and discursive practices. We conclude by studying a concrete case of “negotiation of the invisible” in a correspondence between Carl Linnaeus and John Ellis concerning corpuscles observed in mushroom infusions. (shrink)
